Background (Why is this Action Necessary, and What Action will be accomplished)

body

Background:

Staff initiated a request to amend Section 3-9-52: Bridgeless Barrier Island (BBI) to add “Noncommercial boat docks” as permitted “principal uses and structures.”

The only access to properties located on the bridgeless barrier island chain is via boat or ferry. Noncommercial boat docks have been allowed as permitted “principal uses and structures” under RSF and RMF zoning since 2014 as part of the County Land Development Regulation rewrite. Furthermore, there have been multiple docks built on these properties without a primary use or structure prior to the changes.

On January 12, 2026, the Planning and Zoning Board recommended approval of the proposed revisions.

What Action will be accomplished?

If approved, “noncommercial boat docks” will be allowed as both permitted “principal uses and structures” and accessory uses. This application will be presented to the Board on March 25, 2026, for its adoption hearing.
