BACKGROUND (Why is this Action Necessary, and What Action will be accomplished)

body

Background:

Section 3-3.5-8 of the Charlotte County Code requires the Board to refund impact fees if not used within six years. Section 3-3.5-8 also allows the Board, on a one-time basis by Resolution, to extend the date by which impact fees must be refunded for up to three years.

This Resolution authorizes a one-time, three-year extension of the six-year refund period in which to use Library Impact Fees totaling $55,537.73 expiring in 2024, and Library Impact Fees totaling $112,314.70 expiring in 2025.  Section 3-3.5-9 of the Code allows for the impact fees to be used for a board approved capital improvement project against any proportionate and allowable project cost up to the collection amount.
