BACKGROUND (Why is this Action Necessary, and What Action will be accomplished)

body

Background:

On or about June 26, 2024, the County became a party to the Local Area Program Agreement (the “LAP Agreement”) with the State of Florida Department of Transportation (“FDOT”), the purpose of which is to provide for FDOT’s participation in the acquisition of the rights of way (“ROW”) of ninety-eight (98) fee parcels and thirty-six (36) easements along Harborview Road from Melbourne Street to Interstate 75 (the “Harborview Project”).  The County wishes to utilize the services of a Special Counsel - Eminent Domain - to fulfill its obligations under the LAP Agreement regarding ROW acquisition.  The County and Adams and Reese are parties to existing Contract No. 2006000177 (the “Contract”) for the services of Eminent Domain Attorney Robert Gill.  Because the Harborview Project is funded in whole or in part by federal or FDOT funding, additional provisions specific to federal/FDOT funded projects must be included in the Contract.    Amendment #1 to Contract No. 2006000177 includes the required federal and FDOT contract provisions and updated hourly rates.
