Background (Why is this Action Necessary, and What Action will be accomplished)

Background:

The applicant and property owner, Jaxon Fischer LLC, is requesting a rezoning from Residential Estate 1 (RE-1) to Commercial General (CG). The applicant concurrently applied for a small-scale plan amendment (Application Number PAS-23-00004) to amend the subject property’s Future Land Use Map (FLUM) designation from Burnt Store Limited Development (BSLD) to Commercial (COM), which was approved by the Board of County Commissioners. The subject property is located on the east side of Burnt Store Road, within the boundary of the Burnt Store Area Plan area and in the South County area. The stated purpose of this unified application is to allow a more up-to-date and coherent commercial development with the surrounding properties. The subject site contains approximately 41.31 acres.

On July 8, 2024, the Planning and Zoning Board recommended approved this CG rezoning with a 2-1 vote.

What Action will be accomplished?

The requested rezoning to the conventional CG zoning district does not require a development proposal, site plan, or concept plan as part of the application. If the Board of County Commissioners (BCC) approves this CG rezoning application, it will potentially allow:

                     The future commercial development on the site could be between zero to 300,001 square feet, no additional LOS deficiencies are anticipated, and such development would generally be consistent with the County’s Comprehensive Plan.

                     The commercial development on the site ranges could be between 300,001 and 629,812.26 square feet, the existing County roadway network cannot support the proposed CG rezoning.
