Background (Why is this Action Necessary, and What Action will be accomplished)
body
Background:
The applicant is requesting a rezoning from RE-1 (34.1± acres) and PD (315± acres) to PD, to allow residential development up to 1,000 units or a mixture of residential and commercial development up to a maximum of 466 residential units with 100,000 square feet of commercial uses using the proposed Land Use Equivalency Matrix. The applicant is also requesting to adopt a “General PD Concept Plan” for this proposed development. The subject property includes four parcels. The three parcels located at 15162 and 15170 Burnt Store Road and 26000 Zemel Road are owned by the applicant. The applicant is a contract purchaser of the one unaddressed parcel located immediately to the north of these three parcels. The subject property is located on the southeast of Burnt Store Road and north of Zemel Road, in the boundary of the Burnt Store Area Plan area and in the South County area.
The subject property is designated as Burnt Store Village Residential (BSVR) on the 2030 Future Land Use Map. BSVR FLUM category allows for residential development up to five units per acre, and it allows that ten percent of the subject property may be developed as commercial uses via a PD rezoning process. The applicant is proposing to add a new Land Use Equivalency Matrix to allow for increase or decrease in land uses of retail and residential, which will not increase the number of external peak hour trips. The proposed Land Use Equivalency Matrix provides not only flexibility for development on the subject property but also potentially some commercial uses to serve the proposed residential development and surrounding existing and future residents.
It is staff’s professional opinion that the proposed PD rezoning with conditions is generally consistent with the County’s Comprehensive Plan, the intent of the Burnt Store Area Plan, and it should not create any detrimental impacts on the surrounding residential properties. On August 12, 2024, this PD rezoning application was presented to the Planning and Zoning (P&Z) Board for recommendation. The P&Z Board recommended approval of this PD rezoning application with conditions “a” through “x”.
What Action will be accomplished?
If the Board of County Commissioners approves this PD rezoning with conditions “a” through “x”, it will allow for a residential development up to 1,000 units with no commercial uses or a mixture of residential and commercial development up to a maximum of 466 residential units with 100,000 square feet of commercial uses using the proposed Land Use Equivalency Matrix on the subject property.
