Adopt an Ordinance, pursuant to Section 125.66, Florida Statutes, amending the Charlotte County Zoning Atlas from Planned Development (PD) (265± acres) and Commercial General (CG) (12.55± acres) to PD, in order to have a mixture of residential uses up to 999 residential units and commercial uses up to 195,000 square feet; requiring transfer of density units for residential development above the base density of 26 units; adopting a General PD Concept Plan for the property, including 11 parcels, located at 14290, 14310, 14300, 14330, 14340, 14380, 14400, 14410, 14430, 14440 Burnt Store Road and 26100 Zemel Road; in the Punta Gorda area, within the boundary of the Burnt Store Area Plan area, containing 277.55± acres; Petition No. PD-25-13; Applicant: Burnt Store Road RET-LLC; providing an effective date. Background:

The applicant, Burnt Store Road RET-LLC, is requesting a Planned Development (PD) rezoning from Planned Development (PD) (265± acres) and Commercial General (CG) (12.55± acres) to PD, to allow a mixture of residential uses of up to 999 dwelling units and commercial uses of up to 195,000 square feet. A Transfer of Density Units (TDU) is required for residential development above the base density of 26 dwelling units. The applicant is also requesting adoption of a General PD Concept Plan.

The subject property, consisting of approximately 277.55 acres, is generally located east of Burnt Store Road and north of Zemel Road, in the Punta Gorda area.

The subject property is located along Burnt Store Road and within the boundary of the Burnt Store Area Plan, which encourages higher density and intensity uses. The proposed development allows for a mixture of residential and commercial general uses and includes a proposed Habitat Management Plan to restore and preserve approximately 68.61 acres of onsite wetlands and associated uplands and buffers, which is consistent with the intent of the Emerging Neighborhood designation and the Burnt Store Village Residential Future Land Use Map designation.

Therefore, it is staff’s professional opinion that the proposed mixed-use development is generally consistent with the County’s Comprehensive Plan.

On April 13, 2026, the Planning and Zoning Board recommended approval of this PD rezoning with conditions a through w, by a unanimous vote.

What Action will be accomplished?

If the Board of County Commissioners approves this PD rezoning, it will allow for a mixture of residential uses of up to 999 dwelling units and commercial uses of up to 195,000 square feet on the subject property.
