Recommended Action:
a) Approve Resolution amending the 2005 Hurricane Housing Recovery (HHR) Plan; and
b) Approve the Assignment, Assumption, and Amendment for Genesis Safe House; and
c) Approve the Assignment, Assumption, and Amendment for Genesis Bishop House; and
d) Approve the Assignment, Assumption, and Amendment for Genesis Chara House; and
e) Authorize the Chairman to sign the Resolution and LURAs.

BACKGROUND (Why is this Action Necessary, and What Action will be accomplished)

Background:
On 08.01.2024, Charlotte County Homeless Coalition (CCHC) merged with St. Vincent de Paul CARES (SVdP). CCHC has filed Articles of Dissolution. In exchange for Hurricane Housing Recovery (HHR) funding awarded in 2006, CCHC entered into Funding Contracts (Contracts) and Land Use Restriction Agreements (LURAs) for three (3) properties. As a result of the merger SVdP has requested assignment of the Contracts and LURAs.
Genesis Safe House (Safe) is identified in the current recorded LURA as a 52-bed emergency shelter facility for extremely low-income (ELI) individuals and two parent families whose income is at or below 30% Area Median Income (AMI). Genesis Bishop House (Bishop) is identified as a 6-bedroom (12-bed) “Pregnant Single Females Shelter” for individuals whose income is at or below 30% AMI. Genesis Chara House (Chara) is identified as a 16-bedroom “Single Mothers with Infants/Toddlers Shelter” for individuals whose income is at or below 30% AMI.
On 02.08.2011, the BCC authorized CCHC to lease Bishop and Chara to Community Assisted and Supported Living (CASL) for the purpose of providing housing to special needs tenants (seniors, those with mental illness and/or developmental disabilities). The BCC’s 2011 authorization and change in purpose was never formally memorialized.
SVdP has evaluated the use of these properties and has proposed a change in the purpose and income eligibility criteria to meet the current most prevailing need. The proposals are as follows:
a) Genesis Safe House shall hereinafter be known as “Charlotte CARE Center by SVdP CARES.” The new project objective/purpose shall be: “to provide low-income emergency shelter for homeless individuals and families with children, whose income is at or below 80% AMI.”
b) Genesis Bishop House shall hereinafter be known as “Rosalie Rendue Manor.” The new project objective/purpose shall be: “to provide low-income emergency shelter and transitional programming for homeless individuals, whose income is at or below 80% AMI.”
c) Genesis Chara House shall hereinafter be known as “Frederic Ozanam Manor.” The new project objective/purpose shall be: “to provide low-income emergency shelter for homeless individuals and families with children, whose income is at or below 80% AMI.”
Considering the County’s original HHR strategy which funded these properties specified 30% AMI for special needs housing, staff consulted with Florida Housing Coalition (FHC) and Florida Housing Finance Corporation (FHFC) and received confirmation that the intended purpose and income eligibility criteria proposed by SVdP is appropriate based on the fund source and the fact that the 15-year minimum affordability period has been satisfied. The decision to amend the purpose and income eligibility criteria is a local one. Staff concur with the need and have no objection to any of the proposed changes. The 2005 HHR Plan is being amended to align with this local decision.
Provided for consideration are: Redline changes made to the HHR Plan; the Assignment, Assumption, and Amendment for Bishop, Chara, and Safe Houses which include the Contracts and LURAs attached thereto as exhibits; and a Resolution amending the 2005 HHR Plan.
