Recommended Action:
a) Adopt Resolution approving the 2023-2026 Local Housing Assistance Plan (LHAP) amendment and technical revisions; and
b) Adopt Resolution approving the 2020-2023 Local Housing Assistance Plan (LHAP) technical revisions; and
c) Authorize the Chairman to execute Certifications forms to Florida Housing Finance Corporation.

BACKGROUND (Why is this Action Necessary, and What Action will be accomplished)

Background:
The Affordable Housing Advisory Committee (AHAC) has been reviewing the 2020-2023 and 2023-2026 Local Housing Assistance Plans (LHAPs) since August 2024 to streamline the strategies, address policy statements, consider changes to award amounts, incorporate language that supports the purchase of homes through a Community Land Trust (CLT), and consider CLT capacity-building. After several meetings where LHAP technical revisions and amendments were discussed, an ad hoc committee was established to assist in the incorporation of CLT strategies and finalize all revisions for AHAC and Board of County Commissioner (BCC) consideration. On June 11, 2025, the AHAC approved the ad hoc committee recommendations for BCC approval and certification of the 2023-2026 LHAP amendment and technical revisions, and the 2020-2023 LHAP technical revision.
(*Note: The 2020-2023 LHAP directs the expenditure of State Housing Initiatives Partnership (SHIP) funding cycles FY21, FY22, and FY23. While all three SHIP allocations have been expended, Hurricane Housing Recovery (HHR) funding is subject to the same LHAP provisions as the FY23 allocation. The HHR FY23 expenditure deadline was extended to June 30, 2026. The AHAC recommends technical revisions to align with the 2023-2026 LHAP proposed technical revisions for consistency.)
A summary of the technical revisions to both LHAPs:
- Removes Charlotte HOME process as a requirement for certain strategies, and denoting it as a leveraging opportunity under section I. F. Program Details; and
- Adds a Residency policy statement in Section I.X.a.; and
- Adds a Fraud policy statement in Section I.X.b.; and
- Addresses policy statements regarding mobile/manufactured homes, combining strategies in certain circumstances and not in others, and offers clarification throughout; and
- Increases/amends the award amount, and some terms, for certain strategies based on current trends; and
- Updates Section III. LHAP Incentive Strategies regarding C. Impact Fee waiver (update only; no new recommendation), and I. Public Land Inventory to incorporate AHAC Annual Report recommendations for non-profit developer year-round access to surplus land through Charlotte HOME, and recurring funding opportunities for the Affordable Housing Trust Fund; and
- Formatting and text updates throughout for clarity and consistency.
In addition to these technical revisions, the amendment to the 2023-2026 LHAP is recommended to incorporate the Acquisition/Rehab/Resale strategy currently in the 2020-2023 LHAP and add the Community Land Trust (CLT) Capacity Development strategy.
Provided are the Resolutions adopting the incorporated red-line LHAPs reflecting technical revisions to both LHAPs and amendment to the 2023-2026 LHAP; and the Certification forms for Chairman signature.
