Background:
Taylor Morrison of Florida, Inc. is requesting a Bond Reduction and First Amendment to Developer’s Agreement to reduce the amount of the approved surety for Starling - Phase 1, Replat 1.
The original plat, being a subdivision consisting of 388 single-family lots and 47 tracts, was approved by the Board on July 23, 2024. The applicant has also requested Preliminary and Final Plat approval for a residential subdivision to be named, Starling - Phase 1, Replat 1, consisting of 292 single-family lots and 23 tracts, to revise the plat for consistency with the modification to the Final Detail Site Plan under DRC-24-171. The proposed subdivision would replat portions of Starling - Phase I, as recorded in Plat Book 27, Pages 15A through 15Z2 of the Public Records of Charlotte County. The applicant also seeks approval of the First Amendment to the Developer’s Agreement to acknowledge this replat and modification to the Final Site Plan.
At the time of Final Plat application, the applicant was granted approval of a Developer’s Agreement and surety in the amount of $16,597,801.36, to ensure the completion of the plat infrastructure. The applicant is requesting a reduction in the bond amount due to errors in the original EOPC and reassessment of the cost of construction of improvements since the EOPC associated with the original plat was approved. The original plat was approved before the current subdivision regulations, which requires a construction and maintenance agreement. Thus, the replat has been reviewed under the current subdivision regulations and the applicant is requesting approval of the First Amendment to Developer’s Agreement and Bond Reduction request for the updated Engineer’s Estimate of Probable Construction Cost (+10%), reducing the remaining cost to $16,108,533.55 and including the replat in the agreement.
The County Engineer has approved the Engineer’s Opinion of Probable Cost for the new bond amount.
What Action will be accomplished?
If approved, the Developer’s Agreement will be amended. All improvements must be completed per the approved plans to the satisfaction of the County Engineer within two years of the recording of the replat or a new Developer’s Agreement must be in place and the County will accept the surety provided by Taylor Morrison of Florida, Inc. (Developer).
