Background (Why is this Action Necessary, and What Action will be accomplished)

body

Background:

The applicant and property owner, Blue Luther, LLC, is requesting a rezoning from Residential Multi-family 10 (RMF-10) to Planned Development (PD) to allow for residential development up to 154 residential dwelling units. The applicant is concurrently seeking a small-scale plan amendment to amend the Charlotte County FLUM Series Map #1: 2030 Future Land Use from Medium Density Residential (MDR) to High Density Residential (HDR), which allows for residential development up to 15 units per acre.

The applicant is seeking 51 units of Incentive Density for the proposed affordable housing development; and the applicant is also requesting to adopt the proposed General PD Concept Plan.

Being located outside of the Coastal High Hazard Area (CHHA) makes the property especially well-suited for higher density residential development.

The proposed PD rezoning requires:

•                     A cohesive design for this development and that colors and materials for multi-family buildings shall comply with Section 3-5-508, Building Materials and Colors.

•                     An enhanced buffering and landscaping such that, at a minimum, a Type B buffer is required instead of the Code-required Type A buffer between multi-family development and single-family homes; and, at a minimum, a Type A buffer is required instead of the Code-required no buffer between multi-family uses.

Therefore, it is staff’s professional opinion that the proposed residential development is generally consistent with the County’s Comprehensive Plan.

On February 9, 2026, the Planning and Zoning Board recommended approval of this PD rezoning with conditions a through r, by a unanimous vote.

What Action will be accomplished?

If the Board of County Commissioners approves this PD rezoning and its associated small scale plan amendment, it will allow for residential development of up to 154 units on the property.
