Recommended Action:

a) Authorize the Chairman to sign Part 4: Sections A, B, and C of the Southwest Florida Water Management District permit application; and

b) Approve the Certification of Financial Capability for Perpetual Operations and Maintenance Entities for the Peace River 6 Roadway and Stormwater Project; and

c) Authorize the Chairman to sign the Certification of Financial Capability for Perpetual Operations and Maintenance Entities.

Budgeted Action:

No action needed. Upon Board approval, the annual estimated amount of $4,000 for the perpetual operating and maintenance commitment would be the responsibility of the applicable MSBU.

BACKGROUND (Why is this Action Necessary, and What Action will be accomplished)

Background: 

A property owner who owns properties which they titled Peace River Subdivision at the ends of Banyan Court and Del Rio Court (dedicated, not accepted, undeveloped streets) wants to improve the roadways to get to their properties.  The Property owner is pursuing an Environmental Resource Permit (ERP) from the Southwest Florida Water Management District (SWFWMD) for the construction of Banyan Court and Del Rio Court and stormwater project, identified as Application No. SED #24-0703.

The project site consists of approximately 1.94 acres located at the end of Deep Creek Boulevard in Charlotte County, Florida. The property is currently owned by Charlotte County and is an undeveloped platted roadway.

The proposed project includes:

                     Construction of two 24-foot asphalt roadways, identified as Banyan Court and Del Rio Court

                     Installation of roadside swales

                     Development of roadway infrastructure to provide vehicular access to waterfront residential lots along the Peace River

The roadway and associated stormwater infrastructure will be constructed in one phase.

Stormwater management will be provided by four roadside swales functioning as dry detention systems, which will treat runoff from the proposed asphalt roadways prior to discharge.

The roadways are dedicated, not accepted. Roadways that have not been constructed, and therefore, the permits must be signed by Charlotte County.  If the board chooses to accept the roadways for maintenance once they have been constructed to County standards, the properties along the roadway will be brought into an MSBU for future maintenance. 

As part of the SWFWMD permitting process, the district requires documentation confirming that the entity responsible for operation and maintenance of the stormwater system has the financial capability to maintain the system in perpetuity.

If the board chooses to accept the roadway for maintenance once constructed, Charlotte County Public Works will serve as the Operation and Maintenance Entity responsible for the long-term inspection, operation, maintenance, repair, and replacement of the stormwater management system.
