Approve a Resolution to vacate a portion of the undeveloped Venice Canal, platted in the 1st addition to Rio Villa adjacent to 535 Boardman Drive, which is owned by the applicant. The total area to be vacated contains 1,940± square feet and is generally located north of Canal Way, east of Pelican Pointe Drive, south of Boardman Drive, and west of Palm Drive within the Punta Gorda area. Located in Commission District II.

Background (Why is this Action Necessary, and What Action will be accomplished)

Background:

David Binder is requesting to vacate the westerly portion of the undeveloped Venice Canal adjacent to Lot 11, Block D, 1st addition to Rio Villa, according to the Plat thereof as recorded in Plat Book 4, Page 10A-10C of the Public Records of Charlotte County, Florida and abutting his property located at 535 Boardman. The site contains 1,940± square feet and is in Commission District II.

On October 13, 2025, this request was presented to the Planning and Zoning Board (P&Z Board) with a recommendation of approval.

The applicant has agreed to provide the legal descriptions, sketches, and executed instruments for the easements as required as conditions of approval by the Public Works department and Real Estate Services. If approved by the Board, the applicant would provide the legal descriptions and sketches for the requested easements and execute and record the easement agreements within 180 days of the date of recording of the resolution to vacate the subject portion of the canal basin.

It is staff’s professional opinion that the proposed street vacation is generally consistent with Charlotte County’s Comprehensive Plan, Charlotte County's Code of Laws and Ordinances and other applicable guidelines.

What Action will be accomplished?

If approved, the petition would allow for more developable space on the property. However, the residential development rights will remain the same.
