Pursuant to Section 163.3184(3), Florida Statutes, consider transmittal of a Large Scale Plan Amendment to the Florida Department of Commerce and other State review agencies for review and comment to amend Charlotte County FLUM Series Map #1: 2030 Future Land Use from Agriculture (AG) to Mineral Resource Extraction (MRE), with an annotation requiring: (1) hours of operation for commercial excavation activities from 7:00 a.m. to 4:00 p.m., Monday through Friday; (2) an excavation depth not to exceed 23 feet; and (3) a maximum of 50 truckloads per day. These requirements must be incorporated into a commercial excavation permit. The property is located at 44800 Bermont Road, in the Punta Gorda area and within the East County area; containing 164.66± acres; Commission District I; Petition No. PAL-26-02; Applicant: James Weeks; providing an effective date. Located in Commission District I.

Background:
The applicant, Jim Weeks, is requesting a large-scale plan amendment from Agriculture (AG) to Mineral Resource Extraction (MRE). The applicant is also seeking a rezoning from AG to Excavation and Mining (EM). The subject property is located at 44800 Bermont Road, in the Punta Gorda area and within the East County area. The site contains approximately 164.66 acres. The subject property is currently used primarily as a recreational park (Motocross Park).
Staff reviewed this large-scale plan amendment based on the policies and requirements for an amendment to the MRE Future Land Use category as established in the County’s Comprehensive Plan. The subject property is located outside of the MRE prohibited locations.
It is staff’s professional opinion that the proposed change is generally consistent with the County’s Comprehensive Plan.
On August 10, 2026, the Large-Scale Plan Amendment and its associated EM rezoning were presented to the Planning and Zoning Board for consideration. During the public hearing, citizens raised concerns regarding traffic and environmental impacts. The Planning and Zoning Board recommended denial of both applications by a 3-1 vote.
To address the concerns raised during the P&Z Board public hearing and the anticipated future use of the property as a water park after the applicant’s proposed commercial excavation activities are completed, the following restrictions and conditions are proposed to be added to the proposed MRE Future Land Use Map designation:
(1) Hours of operation for commercial excavation activities from 7:00 a.m. to 4:00 p.m., Monday through Friday.
(2) An excavation depth not to exceed 23 feet.
(3) A maximum of 50 truckloads per day.
What Action will be accomplished?
If the Board of County Commissioners approves this large-scale plan amendment, it will be transmitted to the Florida Department of Commerce and other State agencies for review and comment.
