Background (Why is this Action Necessary, and What Action will be accomplished)

body

Background:

The applicant and property owner, 33 Acres Old Landfill Road LLC, is requesting a rezoning from Residential Estate 1 (RE-1) to Planned Development (PD). The subject property is located at 25495 Old Landfill Road, in the Port Charlotte area. The site contains approximately 33.74± acres. The stated purpose of this PD rezoning application is to allow for a storage yard for Phase I and building trades contractor’s yards in Phase II.

The subject property currently has a Future Land Use Map designation as Low Intensity Industrial (LII), which allows facilities to assemble, market, and distribute products, and engage in research and development. However, since the site is zoned RE-1, there is an inconsistency between the FLUM and zoning designation. The proposed change complies with the approved FLUM amendment annotation, which states that the property must be rezoned to PD. The proposed storage yard and building trades contractor’s yards are permitted under the LII FLUM designation. Therefore, the proposed change is consistent with the County’s Comprehensive Plan.

On February 12, 2024, this PD rezoning application was presented to the Planning and Zoning Board for recommendation. Some concerns were raised during the public hearing. Additional PD conditions have been added in order to address these concerns.

What Action will be accomplished?

If the Board of County Commissioners approves this PD rezoning with conditions “a” through “n”, it will allow for a storage yard for Phase I and building trades contractor’s yards in Phase II on the subject property.
