body
Background:
CC Burnt Store, LLC is requesting Final Plat approval for an application, FP-23-01-01.
This property was originally zoned to PD under Ordinance Number 2007-037, the Coral Creek PD Concept Plan, to allow for a maximum density of 999 units and 200,000 square feet of commercial uses. However, this PD concept plan expired in May 2008. On July 27, 2021, the Board of County Commissioners (Board) adopted Ordinance Number 2021-031 to accomplish two objectives; to extend the Coral Creek PD Concept Plan for 10 years and approve or authorize the Zoning Official to approve a Minor Modification to the Coral Creek PD Concept Plan resulting from taking a portion of the subject property for the Burnt Store Road widening project. On July 27, 2021, the Board approved Resolution Number 2021-110 to transfer three density units onto the subject property, which had a base density of 33 at the time.
On July 26, 2022, the Board approved Resolution Number 2022-096 to transfer 600 density units onto the subject site and Resolution Number 2022-097 to transfer 98 density units onto the site. Therefore, up to 731 units of residential development can be built on the subject property. This Preliminary Plat proposal is consistent with the 731 available density units on the site as of today.
The Board approved petition CDD-22-02 to establish Coral Lakes Community Development District (CDD) on October 25, 2022.
There have been a couple of Minor Modifications to the approved PD Concept Plan. The proposed subdivision is a residential development that received Preliminary Plat approval from the Board under PP-23-01-01 on June 13, 2023, which consisted of 496 single-family lots and 27 tracts. This proposed subdivision is associated with DRC application, DRC-23-00184 Coral Lakes - Phase I - PD Final Detail Site Plan, which was approved on November 8, 2023. Resolution Number 2023-240, which granted PD Final Detail Site Plan approval for DRC-23-00184, for 496 units, which is more than the 228 single-family lots associated with this final plat.
A traffic improvement agreement has been drafted to address the PD Final Detail Site Plan requirement that the Developer shall install, at its expense, a traffic signal on Burnt Store Road at the main residential entrance to the development.
It is staff’s professional opinion that the proposed Final Plat is generally consistent with Charlotte County’s Comprehensive Plan, Charlotte County's Code of Laws and Ordinances and other applicable guidelines.
What Action will be accomplished?
If approved, the applicant will be able to convey lots after the recording of the Final Plat.
