Background:

The applicant and property owner, 5905 Duncan Road LLC, is requesting a small-scale plan amendment to amend the Charlotte County FLUM Series Map #1: 2030 Future Land Use from Low Density Residential (LDR) (4.64± acres) and Agriculture (AG) (8.21± acres) to Commercial (COM).

The applicant is concurrently requesting a companion rezoning (Application Number PD-25-14) from Residential Estate 1 (RE-1) (8.21± acres) and Agriculture (AG) (4.64± acres) to Planned Development (PD) to allow for commercial general uses.

The property is designated as Economic Center in the 2050 Framework map. Approximately 8.21 acres of the property are designated as Agriculture (AG) on the 2030 Future Land Use Map, a designation intended primarily for agricultural activities. The Agriculture (AG) land use category is not an appropriate Future Land Use Map designation to implement the intent of the “Economic Centers” Framework designation.

The subject property is located within the US 17 Area Plan, where the County encourages development that promotes job creation while preserving and enhancing the natural environment. The proposed commercial development use is consistent with and represents encouraged uses within the U.S. 17 Corridor Planning Area.

On March 9, 2026, the Planning and Zoning Board recommended approval of the requested small scale plan amendment by a unanimous vote.

What Action will be accomplished?

If the Board of County Commissioners approves this small scale plan amendment and its associated PD rezoning (PD-25-14), it will allow for the maximum combined square footage of commercial general uses on Lots 1-3 to 70,000 square feet, and allowing only 22 specific Commercial General uses and restrict Lot 4 uses to either a hotel with a maximum of 125 hotel rooms or an indoor storage facility with a maximum building area of 140,000 square feet within a single building.
