Approve an ordinance of the Board of County Commissioners of Charlotte County, Florida, pursuant to Chapter 190, Florida Statutes, amending Part IV, Municipal Service Benefit and Taxing Units, Chapter 4-3.5 Municipal Service Districts, by amending Article XXI: West Port East Community Development District (CDD) to add 104.898± acres of lands, generally located east of the existing CDD to this CDD; and providing for severability; Petition No. CDD-26-01; Applicant: West Port East Community Development District; providing for an effective date. The proposed amended CDD is generally located south of Tamiami Trail (US 41), north of El Jobean Road (SR 776), east of the Flamingo Boulevard, and west of Collingswood Boulevard, in the Port Charlotte area, within the Murdock Village Community Redevelopment Area (CRA), and in Commission District IV. The amended CDD contains 280.775± acres. Located in Commission District IV.

Background:
Pursuant to Section 190.046 (Termination, Contraction, or Expansion of District) and Section 190.005 (Establishment of District), Florida Statutes (F.S.), West Port East Community Development District (CDD) has submitted a petition to Charlotte County to amend Ordinance Number 2024-041 to add approximately 104.898 acres to the existing West Port East CDD.
On December 10, 2024, the Board of County Commissioners (Board) approved a petition to establish the West Port East Community Development District (CDD) via Ordinance Number 2024-041. The subject site for this CDD contains approximately 175.877 acres, and is generally located south of Franklin Avenue, north of El Jobean Road (SR 776), east of the Crestview Waterway, and west of Toledo Blade Boulevard, in the Port Charlotte area, within the Murdock Village Community Redevelopment Area (CRA), and in Commission District IV.
The proposed expansion area is located immediately to the east of the existing CDD.
Staff has reviewed the requested petition considering the six factors established in Section 190.005, Establishment of District, Florida Statutes. It is staff’s professional opinion that expansion of this existing West Port East CDD to include the additional approximately 104.898 acres is consistent with Section 190.046 (Termination, Contraction, or Expansion of District) and Section 190.005 (Establishment of District), F.S., and it is not contrary to Charlotte County’s Comprehensive Plan, Charlotte County's Code of Laws and Ordinances or other applicable guidelines.
What Action will be accomplished?
If the Board of County Commissioners approves this request, it will allow the West Port East CDD to expand to properties located immediately east of the existing CDD, potentially funding the construction of stormwater management systems, roadways, water and wastewater systems, landscaping, hardscape and lighting, amenities, and off-site improvements for these properties.
