BACKGROUND (Why is this Action Necessary, and What Action will be accomplished)

body

Background:

Peace River Community Housing Partners, Inc. (PORCH) was conveyed the vacant parcel at 6296 Scott St. Punta Gorda through the Charlotte Housing Opportunities Made Easier (HOME) Disposition of County Surplus Property process on September 29, 2020.  The conveyance was made subject to a Land Use Restriction Agreement (“LURA”) which incorporated a 36-month deadline for Developer performance.  This deadline was extended to March 9,2025, via Amendment #1 executed on September 19, 2023, due to impacts from Hurricane Ian.  Since the execution of Amendment #1, land use considerations and impacts from Hurricanes Milton and Helene have further delayed development of the property.  PORCH is requesting a 2nd extension until March 31, 2026 to allow for performance.

Under development is a triplex rental, reserved for households with income at or below 30% AMI with preference for veterans.

In January 2022, PORCH was awarded expedited permitting, impact fee waiver ($8,067), and, as a Tier IV awardee, “100% of eligible fee subsidies not to exceed $650,000.”  The trust fund was encumbered for then-reported utility connection fees in the amount of $17,049. The Villas at Scott St. is finally in permitting and has a tentative Certificate of Occupancy date in late November 2025. Due to the identification of additional eligible public fees for subsidy, and a request for Affordable Housing Trust Fund (AHTF) support for sewer extension, PORCH is requesting an increase to the encumbrance of Affordable Housing Trust Fund from $17,049.00 to $208,928.73. An updated Charlotte HOME application was submitted with fee schedule.

On February 19, 2025, the Affordable Housing Advisory Committee (AHAC) considered the request and recommend the following:

a)                     Authorize an increase to the AHTF encumbrance from $17,049.00 to $58,928.73 to cover permit fees and FPL utility connection fees.  FPL fees are not to exceed $40,000.00.

b)                     Consider an additional award of $150,000.00 for sewer extension.  This would provide a community benefit (additional affected parcels identified in application) and furthers the County’s priority of converting septic to sewer. This is within the City of Punta Gorda’s utility service area.

The available, unencumbered balance of the trust fund is $599,419.00.

As per Charlotte HOME policy, the subsidy award is issued in the form of a grant with performance, subject to a LURA. The existing LURA is further amended (Amendment #2) to incorporate the terms, including the request for extension until March 31, 2026.

Provided for review and consideration are: a Resolution approving LURA Amendment #2; LURA Amendment #2, the updated Charlotte HOME application; the current AHTF encumbrance and progress report.
