BACKGROUND (Why is this Action Necessary, and What Action will be accomplished)
body
Background:
The FDOT is undertaking a transportation project along SR 45 (US 41/Tamiami Trail) from Conway Boulevard to Midway Boulevard that includes the construction of sidewalks. Certain areas of the project require access to portions of County-owned right-of-way (ROW).
To proceed, FDOT has requested License Agreements with Charlotte County granting permission to occupy and use specific parcels of County ROW for the purpose of sloping, grading, tying in, harmonizing, and reconnecting existing features with the planned highway improvements. These activities are incidental too and necessary for the completion of the sidewalk project.
In addition to the License Agreements, FDOT has requested that Charlotte County enter into a Transportation Off System Post Project Maintenance Agreement for Financial Project No. 438262-1-52-01. Upon completion of the project, the County will accept responsibility for the ongoing maintenance of the improvements constructed outside FDOT right-of-way and specifically identified in Exhibit “B” of the Maintenance Agreement. These improvements include designated sections of concrete sidewalk, riprap at specified outfalls, and drainage pipe extensions and mitered end sections within the limits identified in the Agreement.
The five (5) License Agreements authorize FDOT's use of the applicable County ROW during construction, while the Post Project Maintenance Agreement establishes the County's responsibility for maintaining the identified improvements following completion of the project.
