Approve an Ordinance pursuant to Section 125.66, Florida Statutes, amending the Charlotte County Zoning Atlas from Planned Development (PD) to PD. This is a major modification to Ordinance Number 2024-017, by amending the adopted PD condition “m” in order to modify the requirements of the “natural buffer with 25 feet in width”, for property generally located south of Franklin Avenue, north of El Jobean Road (SR 776), east of the Crestview Waterway, and west of Toledo Blade Boulevard, in the Port Charlotte area, within the Murdock Village Community Redevelopment Area (CRA), and containing 630.82± acres; Petition No. PD-25-09; Applicant: KL Westport Expansion LLC; providing an effective date. Located in Commission District IV.

Background (Why is this Action Necessary, and What Action will be accomplished)

Background:

The applicant, KL Westport Expansion LLC, is requesting a major modification to the existing Ordinance Number 2024-017, by amending the adopted PD condition “m” in order to modify the requirements of the “natural buffer with 25 feet in width”.

The subject property is generally located south of Franklin Avenue, north of El Jobean Road (SR 776), east of the Crestview Waterway, and west of Toledo Blade Boulevard, in the Port Charlotte area, within the Murdock Village Community Redevelopment Area (CRA) and in Commission District IV. It contains approximately 630.82 acres.

30 trees that had equal to or greater than eight inches Diameter at Breast Height (DBH) and palms equal to or greater than 12 inches DBH have been removed from Area 1 of the required 25-foot “natural buffer” due to installation of utilities, which is contrary to the “natural buffer” requirement. The proposed changes to rectify this situation.

It is staff’s professional opinion that the proposed revision to the existing PD condition “m” shall not have any negative impacts on surrounding residential uses. The proposed amendment to condition “m” still requires more plantings than are typically required in a “perimeter landscape strip” for commercial development along SR 776.

What Action will be accomplished?

If the Board of County Commissioners approves this application, it will allow for similar trees to those removed from natural buffer Area 1 and outside of the PUE to be replanted in previous general locations to achieve the original intent of the “natural buffer”, to establish the process of this rectification, and to provide better visibility for the proposed commercial development.
