Background (Why is this Action Necessary, and What Action will be accomplished)

body

Background:

The applicant, Ainger Landing, Inc., is requesting this application to certify Sending Zones (SZs) covering approximately 25.59 acres. The subject property includes four parcels which are located at 7022, 7100, 7120, and 7140 Riverside Drive, and one parcel (P15-1-1) is generally located northwest of Seminole Gulf Railroad and north of Riverside Drive, in the Punta Gorda Area, and within the East County area.  If approved, this petition will certify 119 units of transferrable density and eight units would be retained on the four parcels located at 7022, 7100, 7120, and 7140 Riverside Drive, two units per parcel. Parcel P15‐1‐1 is a triangle‐shaped lot, containing approximately 6,500 square feet, which is not an ideal developable parcel as a stand‐alone lot, and is not required to retain density.

This CSZ request is consistent with Future Land Use (FLU) Policy 1.2.9:  TDU Sending Zones and meets 3 of 11 criteria as set forth in this policy. This CSZ request meets the County TDU Code (Section 3-9-150) requirement.

It is staff’s professional opinion that the request to certify 119 units of transferrable density is consistent with the County’s Comprehensive Plan, the intent and criteria for the County’s Transfer of Density Units program, Charlotte County’s Code of Laws and Ordinances, and other applicable guidelines.

What Action will be accomplished?

If the Board of County Commissioners approves this petition, it will allow the applicant/property owner to sever 119 density units from the subject property located in the East County area.
