REQUESTED MOTION/ACTION

Recommended Action:
a) Rescind award of Request for Bid #26-549, Gasoline/Diesel Fuel, Supply & Deliver - Annual Contract, for Group A: Tank Wagon Lots, as awarded to Campbell Oil Company of Elizabethtown, North Carolina; and
b) Approve award of Group A: Tank Wagon Lots to the next lowest responsive, responsible bidder, Rogers Petroleum Inc. of Morristown, Tennessee, at the firm differential prices indicated on the bid tabulation, for the period beginning November 1, 2026, through and including September 30, 2027; and
c) Authorize the County Administrator, or his designee, to approve renewal options for up to two (2) additional one (1) year terms at the same prices, terms and conditions, by mutual consent.

Budgeted Action:
No action needed. Fuel purchases will be funded by the Fleet Management Fund, and then will be charged back to the departments as proposed during the FY2027 budget process.

BACKGROUND (Why is this Action Necessary, and What Action will be accomplished)

Background:
The purpose of this annual contract is to provide gasoline and diesel fuel to County fueling facilities. Group A covers Tank Wagon deliveries of 2,500 gallons or less.
At its September 22, 2026 meeting, the Board approved award of Group A: Tank Wagon Lots to Campbell Oil Company of Elizabethtown, North Carolina. Following approval, Campbell Oil Company advised the County that it had inadvertently transposed its bid prices between the Transport and Tank Wagon bid groups. Due to the substantial difference in pricing between these delivery groups, the company requested withdrawal of its bid, stating that it could not honor the prices submitted on its Bid Form.
The bid specifications provide for award based on the lowest firm differential submitted, either in whole, in part, or by group. The firm differential is added to the applicable published OPIS Tampa market price to determine the delivered price per gallon.
Therefore, recommend rescinding the award to Campbell Oil Company and awarding Group A: Tank Wagon Lots to the next lowest responsive, responsible bidder, Rogers Petroleum Inc. of Morristown, Tennessee, at the firm differential prices indicated on the bid tabulation, for the period beginning November 1, 2026, through and including September 30, 2027, with the option to renew for two (2) additional one-year terms at the same prices, terms and conditions, by mutual consent.
