b) Authorize the Chairman to sign the Subordination of County Utility Interests Agreement between Charlotte County and the Florida Department of Transportation.

BACKGROUND (Why is this Action Necessary, and What Action will be accomplished)

Background: 

The Florida Department of Transportation (FDOT) has identified certain lands necessary for highway purposes in connection with transportation improvements associated with the Biscayne Landing project. Charlotte County holds utility interests within portions of the subject right-of-way.

FDOT requires execution of a Subordination of County Utility Interests Agreement in order to subordinate the County’s existing utility interests to FDOT’s interests in the right-of-way to allow the proposed highway improvements to proceed. Under the agreement, Charlotte County agrees to subordinate its utility interests to FDOT for highway purposes, and FDOT agrees to pay for relocation of County utility facilities, if necessary, to avoid conflicts and allow both uses to coexist. Execution of this agreement is a standard requirement for FDOT right-of-way acquisitions and is necessary to support the advancement of the project.
