recommendation
Recommended Action:
a) Approve the Addendum to Second Amended and Restated Off-Site Utilities Agreement between Charlotte County and Tuckers Pointe Community Development District, confirming all parties’ agreement on memorializing the Water and Sewer TAP Fees (transmission fees, accrued guaranteed revenue fees, and plant fees); and
b) Authorize the Chairman to sign the Addendum.

BACKGROUND (Why is this Action Necessary, and What Action will be accomplished)

Background:
In September 2018, the County entered into and recorded an Original Off-Site Utilities Agreement with Tuckers Point for Potable Water, Wastewater, and Reclaimed Water.
The County and Tuckers Point entered into a Partnership Agreement for Reimbursement Costs in November 2021.
The County and Tuckers Point entered into a First Amended Agreement in November 2019, and then a Second Amended Agreement was approved by the Board in November 2021.
Various water and sewer TAP fees for the Project have already been paid to the County. The Addendum to Second Amended and Restated Off-Site Utilities Agreement is to confirm all parties’ agreement on memorializing the Water and Sewer TAP Fees (transmission fees, accrued guaranteed revenue fees, and plant fees).
