BACKGROUND (Why is this Action Necessary, and What Action will be accomplished)

Background:
Charlotte HOME (Housing Opportunities Made Easier), an incentive program for affordable housing developers, was adopted by the Board of County Commissioners (BOCC) on July 28, 2020, (Res. 2020-09) to reduce barriers and attract developers of affordable housing to Charlotte County. It was amended on November 14, 2023, (Res. 2023-219) and on April 14,2026, (Res. 2026-062) to update documents, definitions, award criteria, and streamline processes. It is presented for additional modifications to further streamline the process, defining loan eligibility and loan terms. Proposed modifications include:
Text amendments throughout to better define the program, incentives, and subsidies, and align with text references in the Local Housing Assistance Plan (LHAP); and
Updated the Levels of Review to address when AHAC/BCC review and approval is necessary for impact fee waiver when BCC verification of contribution is required for applicant eligibility for Florida Housing Finance Corporation (FHFC) RFAs; and
Addition of a section on Loan Authorization that defines loan eligibility and terms, including repayment terms on for-profit loans; and
Addition of a section on Qualified Non-Profit to define minimum requirements for non-profit access to incentives, subsidies, non-profit loan terms, etc., to include documentation standards
Requirement for a Land Use Restriction Agreement (LURA) when impact fee waiver is awarded for multi-family rental units when no other incentives, subsidies, or funding are requested or awarded....
