BACKGROUND (Why is this Action Necessary, and What Action will be accomplished)

Background:
Peace River Community Housing Partners, Inc. (PORCH) was conveyed five (5) county-owned rental properties through the Charlotte Housing Opportunities Made Easier (HOME) Disposition of County Surplus Property process on September 29, 2020. The conveyance was made subject to Land Use Restriction Agreements (LURAs) which incorporated the tenant eligibility criteria proposed by PORCH in the competitive RFP process: Extremely Low-Income (ELI), or < 30% area median income (AMI), veterans. As a Community Land Trust (CLT), PORCH will hold the rentals affordable in perpetuity.

PORCH has requested an amendment to the tenant eligibility criteria and LURAs. As the ELI limitation creates the potential for affordable rental units to be vacant for greater than 90 days, there is a deficit of affordable rental units for both Very Low-Income (VLI < 50% AMI) tenants and Low-Income (LI < 80% AMI) tenants, and the County desires to limit vacancy of affordable rental units, it is proposed that if after 90 days, a unit remains vacant due to the inability to identify an ELI veteran tenant, the unit may be rented to a VLI or LI tenant.

On June 11, 2025, the Affordable Housing Advisory Committee (AHAC) considered the request and recommends the approval of the LURA amendments.
