BACKGROUND (Why is this Action Necessary, and What Action will be accomplished)

body

Background:

As Charlotte County transitions to entitlement status for Community Development Block Grant (CDBG) funding, the County becomes a Responsible Entity and is required to complete environmental reviews in accordance with the National Environmental Policy Act (NEPA) and HUD environmental review regulations at 24 CFR Part 58. These reviews must be certified by a designated Certifying Officer who assumes legal responsibility for compliance with NEPA and all associated federal environmental authorities.

Pursuant to 24 CFR § 58.13, the Certifying Officer must have the authority to execute the Request for Release of Funds and Certification as outlined in 24 CFR § 58.71 and accept responsibility for the environmental review process on behalf of the County. This resolution formally delegates that authority to the County Administrator, ensuring the County maintains compliance with HUD and federal environmental requirements for all CDBG, HOME, ESG, CDBG-DR, and CDBG-MIT funded activities, while enabling timely project implementation and fund disbursement.
