Recommended Action:
a) Approve the Settlement Agreement and Releases and the Agreement for Purchase and Sale of Real Property in the case of Michael Colosi v Charlotte County, Florida, et al, relating to several constitutional violations due to the presence of scrub jays; and
b) Authorize the Chairman of the Board to sign the Settlement Agreement and Releases and the Agreement for Purchase and Sale of Real Property.

BACKGROUND (Why is this Action Necessary, and What Action will be accomplished)

Background:
This settlement agreement will resolve the claim of Michael Colosi against Charlotte County Board of county Commissioners. Michael Colosi alleged several constitutional violations due to the presence of the Federal Protected Scrub Jay upon the land. The Settlement Agreement would transfer ownership of the land from Michael and Ryan Colosi to Charlotte County for the appraised value. Charlotte County would be adding the acquired land to its existing conservation land.
