Approve an Ordinance of the Board of County Commissioners of Charlotte County, Florida, amending Charlotte County Code Chapter 3-9: Zoning, by revising Article I: In General, Section 3-9-2: Rules of Construction; Definitions to change the name of “Adult Congregate Living Facility” to “Assisted Living Facility” and to revise the definition of “Assisted Living Facility”, and by amending Article III: Special Regulations to create new Section 3-9-62.1: Certified Recovery Residences; Application number: TLDR-25-04; Applicant: Charlotte County Board of County Commissioners; providing for inclusion in the Charlotte County Code; providing for conflict with other ordinances; providing for severability; and providing for an effective date. This applies countywide.

Background (Why is this Action Necessary, and What Action will be accomplished)

Background:

Staff initiated this text amendment to amend Sections 3-9-2: Rules of Construction; Definitions and to create New Section 3-9-62.1: Certified Recovery Residences in order to comply with Senate Bill (SB) 954: Certified Recovery Residences which was approved by the Governor on June 25, 2025.

On October 13, 2025, the Planning and Zoning Board recommended approval of the proposed revisions.

What Action will be accomplished?

If approved, the County’s Land Development Regulations will meet the requirements of SB 954 to establish the process and requirements for certified recovery residences.
