BACKGROUND (Why is this Action Necessary, and What Action will be accomplished)

Background:
Carl Baker is a former Public Works employee who separated from County employment in 2016. A mediated settlement was tentatively reached on June 5, 2026, subject to approval by the Board. The proposed settlement is $98,643.50 for one (1) workers’ compensation claim. A significant portion of the settlement is allocated toward the purchase of an annuity to fund a Medicare Set-Aside (MSA), as required to protect Medicare’s interests with respect to future medical expenses related to the workers’ compensation claim. This claim presents significant potential exposure to the County and, if left unresolved, could result in substantial workers’ compensation costs over the course of the former employee’s lifetime. The proposed settlement would resolve the County’s ongoing exposure associated with this claim.
