b) Authorize Chairman to sign the Off-Site Utilities Agreement.

No action needed. Budgeted in Capital Improvement Project “Water Transmission/Wastewater Collection Reimbursement” as approved in the FY26 budget process. Funding will be supplied by the Utility Water Connection Fee Fund and Utility Wastewater Connection Fee Fund.

BACKGROUND (Why is this Action Necessary, and What Action will be accomplished)

Background: 

The developer, KL Westport Expansion, LLC, whose address is 105 NE 1st Street, Delray Beach, FL is currently developing property located within Charlotte County and Charlotte County Utilities’ service area.  The developed property includes a residential subdivision (West Port East) “PROJECT”, which will require certain off-site improvements to the County’s water and sewer transmission systems to connect the project to the County’s water and sewer system.

 

Developer has agreed to construct off-site water and sewer transmission system improvements needed to connect Developer’s property to County’s water and sewer system.

 

The County has requested the developer increase the size of the potable water transmission lines beyond the size required to service the project, to accommodate future County needs. The County desires to reimburse Developer for the cost of oversizing the off-site potable water transmission lines, and installation of potable water, fire, and sewer services.

 

The Board discussed the cost share project at 11.12.24 BCC meeting and approved Utilities to move forward with Off-Site Utility Agreement.
