Recommended Action:
a) Approve Kings Highway Widening Credit Purchase Agreement between Charlotte County and J.R. Paul Properties and the Certification of Financial Capability for Perpetual Operations and Maintenance Entities; and
b) Authorize the Chairman to sign the Kings Highway Widening Credit Purchase Agreement and the Certification of Financial Capability for Perpetual Operations and Maintenance Entities.

Budgeted Action:
No action needed. Budget is available in the Capital Improvement Project "Kings Highway Widening - I75 to Desoto County Line" as approved in the FY25 budget process for the mitigation credit of $53,200, funded by Road Impact Fees. Annual estimated operating and maintenance in the amount of $10,908 will be funded by the Mid-Charlotte Stormwater Street and Drainage MSBU assessments.

BACKGROUND (Why is this Action Necessary, and What Action will be accomplished)

Background:
The County is seeking approval to address the final Request for Additional Information (RAI) from the Southwest Florida Water Management District (SWFWMD) to move forward with the Kings Highway Widening Project that impacts a wetland located on a County-owned pond parcel. As part of the permitting process, SWFWMD is requiring mitigation credits to offset the environmental impacts of this wetland disturbance. This is a standard procedure for projects involving wetland impacts, as required by Rule 62-330.301(4), F.A.C., and Subsection 10.3 of the Applicant's Handbook Volume I. Purchasing mitigation credits ensures the County meets its environmental responsibilities while allowing the project to proceed.
