Recommended Action:
a) Approve Off-Site Utility Agreement between the County and the Developer, DRP FL 9, LLC for the Willow Phase 3 Project; and
b) Authorize Chairman to sign the Off-Site Utility Agreement.

No action needed. Budgeted in Capital Improvement Project “Water Transmission/Wastewater Collection Reimbursement” as approved in the FY26 budget process. Funding will be supplied by the Utility Water Connection Fee Fund and Utility Wastewater Connection Fee Fund

BACKGROUND (Why is this Action Necessary, and What Action will be accomplished)

Background:
On April 22, 2025, the Board discussed the cost-share project and approved Utilities department to move forward with the Off-Site Utility Agreement.
The developer, DRP FL 9, LLC, whose address is 520 Madison Ave, 21st FL, New York, NY 10022, is currently developing property located within Charlotte County and Charlotte County Utilities’ service area. The developed property includes a residential subdivision, Willow Phase 3 (“PROJECT”), which will require certain off-site improvements to the County’s potable water distribution system to connect the project to the County’s potable water system.
The County has requested that the developer increase the size of the off-site potable water distribution lines beyond the size required to serve the project in order to accommodate future County needs. The County desires to reimburse the Developer for the cost of oversizing the off-site potable water distribution lines.
The Developer has agreed to construct the off-site potable water distribution system improvements needed to connect the Developer’s property to the County’s potable water system.
