The County is in the process of preparing a Request for Proposal (RFP) for the procurement of audit services, required by Chapter 218 of the Florida Statutes. The last audit contract, entered into in 2017, is expiring.
Section 218.391 of the Florida Statutes requires that the BCC must establish the auditor selection committee, which, at a minimum, must consist of each of the County Constitutional Officers (or their designees) and one member of the BCC (or its designee).
The current statute, however, provides that, “An employee, a chief executive officer, or a chief financial officer of the county…may not serve as a member of the auditor selection committee established under this subsection; however, an employee, a chief executive officer, or a chief financial officer of the county…may serve in an advisory capacity.” §218,391(2)(c), Fla. Stat. (italics added).
The Auditor General has interpreted this provision to mean that, “…a county officer may not designate an employee of a county officer to serve in place of the county officer on the county auditor selection committee.” The employee may serve in an advisory capacity, however.
Accordingly, the persons who may serve on the Audit Selection Committee are now limited to each Constitutional Officer (or his/her designee) and one BCC member (or his designee). The statute does not define who may be a “designee” other than to say it may not be an employee.
